Insolvency proceedings Metallbau Mildenberger GmbH & Co. KG

Insolvency proceedings against the assets of Metallbau Mildenberger GmbH & Co. KG were initiated on July 1, 2017; in the meantime, the insolvency administrator, attorney Jutta Rüdlin from the law firm BRRS Attorneys-at-Law Insolvency Administration Restructuring in Melsungen, has succeeded in finding an investor for the company who will take over the business operations per January 20, 2018.

The investor is THELEN HOLDING GMBH, headquartered in Essen, a midsize company that has specialized in the purchase, leasing, and management of real estate properties in Germany since 1988. The company is proficient in handling the key functions of the traditional real estate process from acquisition, project development, and construction management to leasing and management through its own subsidiaries and with qualified employees. The Thelen Group has strengthened its position for the management of its properties and the performance of upcoming major projects such as ESSEN 51, the creation of a completely new city district, through the acquisition of several key trades for real estate construction and support.

Contact was extended and the transferring reorganization was ultimately realized by the investor process initiated by the insolvency administrator with the support of FalkenSteg GmbH, a partner-led consulting firm specializing in corporate finance and restructuring at offices in Frankfurt am Main, Munich, and Düsseldorf. The new company will operate in the future at the Spangenberg site under the name Fenster- und Metallbau Mildenberger GmbH. The transfer of the operations to the newly founded company saved all 24 jobs.

The investors aim to maintain the existing product range of the Spangenberg-based metal construction company and intend to expand the maintenance division. The management comprises the siblings Michaela and Markus Mildenberger together with Mr. Wolfgang Thelen and his son Christoph Thelen. The investors are relying on good and close cooperation with the management and the workers employed in the company. The Mildenberger company once employed as many as 70 people. The investors want to increase the size of the company again in the long term by hiring highly qualified specialists that will strengthen and expand its position on the market.

Attorney Jutta Rüdlin, the insolvency administrator, has been working as an insolvency administrator in northern Hesse for 15 years and together with her team has successfully handled more than 1,000 insolvency proceedings of various dimensions. She is a partner of the law firm BRRS Attorneys-at-Law Insolvency Administration and Restructuring and is director of the office in northern Hesse.

The law firm BRRS Attorneys-at-Law was founded on January 1, 2018, by the former partners of the law firm HENNINGSMEIER Attorneys-at-Law Joachim Büttner, Ulrich Rosenkranz, Dr. Stephan Schlegel, and Jutta Rüdlin. The four experienced insolvency attorneys and their team of about 50 employees are active in the field of insolvency and property administration at the offices in Erfurt, Eschborn, Hamburg, Melsungen, and Ribnitz-Damgarten.
