3rd digital workshop by BRRS Rechtsanw\u00e4lte on 26 April 2022<\/strong><\/h2>\n

The IX Civil Senate of the Federal Court of Justice is continuing the reorientation of case law on avoidance with intent pursuant to section 133 InsO with great intensity. The 3rd Digital Workshop of BRRS Rechtsanw\u00e4lte will focus on the two decisions of 3 March 2022 (IX ZR 53\/19; IX ZR 78\/20):<\/p>\n

BGH IX ZR 78\/20<\/strong><\/h3>\n

In IX ZR 78\/20, the IX Civil Senate distinguished, among other things, the reference point of intent under Section 133 InsO from Sections 15a, b InsO, so that the time limits and injunctions resulting from Sections 15a, b InsO do not determine the requirements for contesting intent. It has also been recognised there that intent can be assumed if the (future) creditors are deliberately burdened with the risk by an unsuitable restructuring attempt. According to this decision, lawyers, tax advisors and reorganisation consultants can be related parties of a debtor pursuant to Section 138 InsO.<\/p>\n

IX ZR 53\/19<\/strong><\/h3>\n

In IX ZR 53\/19, the BGH recognised, among other things, that over-indebtedness under insolvency law is an independent sign of evidence of intent to disadvantage and knowledge.<\/p>\n

BRRS Rechtsanw\u00e4lte would like to analyse the two decisions and place them in the context of insolvency proceedings. We are delighted to have Prof. Dr Christoph Thole<\/a>, University of Cologne, Director of the Institute for Procedural Law and Insolvency Law and the Institute for International and European Insolvency Law, as a speaker and discussion partner. The event consists of a lecture part, a Q&A session moderated by BRRS partner Joachim B\u00fcttner<\/a> and a joint professional exchange.<\/p>\n
