{"id":7874,"date":"2020-07-02T14:53:30","date_gmt":"2020-07-02T12:53:30","guid":{"rendered":"https:\/\/www.brrs-rechtsanwaelte.de\/?p=7874"},"modified":"2021-05-28T10:09:32","modified_gmt":"2021-05-28T08:09:32","slug":"anfechtung-von-mietzahlungen-an-grundpfandglaeubiger-bgh-entscheidet","status":"publish","type":"post","link":"https:\/\/www.brrs-rechtsanwaelte.de\/de\/2020\/07\/02\/anfechtung-von-mietzahlungen-an-grundpfandglaeubiger-bgh-entscheidet\/","title":{"rendered":"Anfechtung von Mietzahlungen an Grundpfandgl\u00e4ubiger &#8211; BGH entscheidet"},"content":{"rendered":"<section class=\"l-section wpb_row height_medium\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_flex valign_top type_default stacking_default\"><div class=\"vc_col-sm-12 wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\"><div class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><p>Der Bundesgerichtshof (BGH) hat zu Gunsten des Insolvenzverwalters entschieden, dass in dem Falle, in dem an einen Grundpfandgl\u00e4ubiger Mieten gezahlt werden, die in den Haftungsverband eines Grundpfandrechts fallen, die Gl\u00e4ubigergesamtheit benachteiligt ist, wenn die den Zahlungen zugrundeliegenden Mietforderungen\u00a0 nicht insolvenzfest beschlagnahmt waren.<\/p>\n<p>Dies hat zur Folge, dass der Insolvenzverwalter die Zahlungen von dem Gl\u00e4ubiger im Wege der insolvenzrechtlichen Anfechtung zugunsten s\u00e4mtlicher Insolvenzgl\u00e4ubiger zur\u00fcckfordern kann.
